Terms of Service

1. Agreement to Terms

Welcome to LandWise. By accessing or using our website (landwise.earth) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms are an agreement between you and LandWise, operating from Ko Pha Ngan, Surat Thani, Thailand. Our contact details are in section 14.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the updated Terms.

2. Services Description

LandWise provides land and property intelligence services. Our products are:

• Land Analysis: a drone survey of a plot and the report produced from it, covering terrain, buildability, slope and access. Available with an optional LandWise Consultation add-on.
• Property Explorer: an interactive 3D model of a plot or finished property, built by us and hosted by us at a web address we provide. Priced as a one-time creation fee by property size plus an annual hosting fee. See section 4.5.
• Agency Partner (the LandWise Network): a recurring subscription for agencies, including a branded Explorer, portfolio-wide hosting, team accounts, and partner rates on each listing. See section 4.4.

Delivering these involves drone surveying and aerial photography, photogrammetry, 3D terrain and property modeling, and topographic and site analysis. Section 7.4 sets out what these methods can and cannot be relied on for, and it is important that you read it.

We may add, change or retire products at any time. What you are entitled to is what was published for your product at the time you ordered it, together with anything separately agreed in writing.

3. Service Packages and Pricing

3.1 Early Access Pricing

We offer limited-time early access pricing while building our portfolio. Early access prices are subject to availability and may be discontinued at any time without notice.

3.2 Service Scope

Each package includes specific deliverables as outlined on our website. Additional services or requests beyond the package scope may incur additional charges.

4. Booking and Payment

4.1 Booking Process

Service bookings are confirmed upon receipt of payment or execution of a service agreement. We reserve the right to decline service requests at our discretion.

4.2 Payment Terms

• Payment is typically required upfront or as specified in your service agreement
• Prices are quoted in Thai Baht (THB) unless otherwise specified
• Additional expenses (travel to remote locations, specialized equipment) will be communicated before work begins

4.3 Cancellation and Refunds

By Client, before the flight: we schedule your flight and confirm the date by email, as described in section 5.1. You may cancel at any time up to 48 hours before that confirmed date. Refunds are subject to a 20% administrative fee. Because the date is ours to set and not yours, cancelling more than 48 hours before a date we have not yet confirmed is always treated as a cancellation in good time.

By Client, within 48 hours of the confirmed date: non-refundable, because the flight has been scheduled and the day committed. If you cancel in this window we will, at our discretion, offer to reschedule instead.

By Client, after the flight: once the flight has taken place the survey has been carried out and the work is substantially performed, so the fee is non-refundable. This applies whether or not the report has been delivered to you yet.

Property Explorer: a listing build may be cancelled for a full refund at any time before we begin building it. Once building has started the creation fee is non-refundable, because the model is made for your specific property and has no other use.

Agency Partner subscriptions: see section 4.4, which governs renewal and cancellation of the subscription.

By LandWise: We may cancel services due to weather, safety concerns, or other unforeseen circumstances. In such cases, you will receive a full refund or the option to reschedule. Rescheduling a weather-affected flight is not a cancellation and carries no fee, as set out in section 5.3.

4.4 Agency Partner Subscriptions (LandWise Network)

The LandWise Network (Agency Partner) is a recurring subscription for agencies, separate from one-off service bookings. It is offered on two plans:

• Annual: a platform fee of ฿30,000 per year, which locks your partner rates for 12 months. The annual term renews automatically for a further 12 months unless cancelled before the renewal date.
• Monthly: a one-time setup fee of ฿7,500 plus ฿3,000 per month. The monthly plan renews automatically each month and may be cancelled at any time, effective at the end of the current paid month. If you move from Monthly to Annual within three months of joining, the ฿7,500 setup fee is credited in full toward your Annual fee.

What the platform fee covers: access to the LandWise Network, your own branded Explorer, portfolio-wide hosting for every live listing, team accounts, and your partner rate on each listing. The platform fee does not include the creation of individual listings, which are quoted and billed separately per property by size at your partner rate.

Auto-renewal and cancellation: subscriptions renew automatically until cancelled. You may cancel in writing (email is sufficient). Cancelling the Annual plan stops future renewals; the current 12-month term is not refunded on a pro-rata basis except where required by law. Cancelling the Monthly plan stops future monthly charges from the end of the current paid month. The ฿7,500 Monthly setup fee is non-refundable except as a credit toward Annual as described above.

Hosting and lapse: your listings remain live on LandWise Explorer for as long as your subscription is active. If a subscription lapses or is cancelled, hosting for your portfolio ends and your listings are taken offline. We will give you reasonable notice before taking listings offline for non-payment, and reinstating them later may require a new setup. Prices are quoted in Thai Baht (THB) and may be revised for future renewal terms on reasonable notice; your Annual rate lock protects your rates for the duration of each 12-month term.

4.5 Property Explorer Hosting (individual listings)

A Property Explorer bought on its own, outside an Agency Partner subscription, is priced in two parts: a one-time creation fee by property size, and an annual hosting fee of ฿6,000 per listing at the rate published on the product page when you order.

What hosting covers: keeping your Explorer live at the web address we provide, serving it to anyone you share the link with, and the running costs of the 3D model and its media.

Renewal and lapse: hosting runs for 12 months from the date your Explorer goes live and is invoiced annually. It is not charged automatically to a saved card; we will invoice you before each renewal, so hosting continues only if you choose to renew. If hosting is not renewed, we will give you reasonable notice and then take the listing offline. We keep your model for at least 90 days after it goes offline so it can be restored without rebuilding it, after which it may be deleted. Restoring a listing after that point may require a new creation fee.

5. Service Delivery

5.1 Timeline

For Land Analysis, the 48-hour delivery window begins when the drone flight is completed, not when you place your order or pay. Flights are scheduled in the order bookings are received and are weather-dependent, so your flight may take place several days after purchase; we confirm the flight date by email. All delivery timelines are estimates and may vary with weather, site access, flight scheduling, and project complexity. We will notify you of any significant delay.

5.2 Site Access

You are responsible for ensuring we have legal access to the property. You must obtain any necessary permissions from property owners or authorities.

5.3 Weather Dependency

Drone operations are weather-dependent. Service may be rescheduled due to adverse weather conditions without penalty to either party.

6. Intellectual Property

6.1 Deliverables

Upon full payment, you receive a non-exclusive, non-transferable license to use the deliverables (maps, models, reports) for your personal or business purposes related to the surveyed property.

6.2 LandWise Rights

We retain the right to use project images, data, and outputs for marketing, portfolio, and promotional purposes, unless you tell us not to.

Opting out is free. There is a checkbox at checkout, "Keep my project private", and ticking it means we will not use your plot, images or analysis for marketing, portfolio or promotion. You can also ask us in writing at any time, including after delivery, and we will withdraw the material from anywhere we still control. We never publish your title deed or your contact details in any case.

6.3 Restrictions

You may not resell, redistribute, or commercially exploit our deliverables without written permission.

7. Warranties and Disclaimers

7.1 Professional Services

We provide professional land intelligence services using industry-standard equipment and methods. However, our services are NOT:

• Legal surveys for property boundaries or titles
• Engineering design or structural analysis
• Environmental impact assessments
• Official government-approved documentation

7.2 Recommendations

Any recommendations or assessments we provide are for informational purposes only. You should consult with licensed professionals (engineers, architects, lawyers) before making property decisions.

7.3 No Warranty

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.

7.4 Survey Accuracy & Measurement Limitations

Our 3D models, topographic contour maps, elevation (DEM) data, slope analysis, and any measurements, distances, areas, or boundary lines are produced by drone photogrammetry, not by an RTK/GNSS-corrected ground survey or a licensed cadastral surveyor. They are indicative and intended for planning and visualisation purposes only, carry an inherent margin of error, and must not be relied upon as a legal, cadastral, or boundary survey. They must not be used for land titling, boundary determination, legal disputes, construction setting-out, or any official or regulatory submission. Where a certified survey is required, you must engage a licensed Thai cadastral surveyor. We can arrange a certified cadastral survey as a separate deliverable on request.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• LandWise shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific service
• We are not responsible for decisions you make based on our reports or recommendations

You agree to indemnify and hold LandWise harmless from any claims arising from your use of our services.

9. Privacy and Data

Your use of our services is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

10. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, government actions, strikes, pandemics, or equipment failures.

11. Governing Law

These Terms are governed by the laws of Thailand. Any disputes shall be resolved in the courts of Surat Thani, Thailand.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and LandWise.
